OUR 10 PRIVACY PRINCIPLES:

Here is a summary of our Privacy Principles.

  1. Accountability
  2. We have designated a Privacy Officer who is accountable for our compliance with the letter and spirit of the law and these policies. Where personal information originates from outside Alberta, WCTL will continue to apply these policies. As part of our on-going commitment our staff will receive annual privacy training.

  3. Identifying purposes
  4. When we ask for personal information, we will identify the purposes for which it will be used or disclosed.

  5. Consent
  6. We require your knowledge and expressed or implied consent for the collection, use or disclosure of personal information. This may be through a combination of a form of consent you signed as a condition of employment and specific forms you will be given. Individuals may withdraw their consent at anytime subject to legal or contractual or employment restrictions and considerations.

  7. Limiting Collection
  8. Collection of personal Information is limited to the purposes identified to you and will be collected in a lawful manner. Typically this may include: copies of Workers Compensation Board forms and documents; employers (particularly the report of the occurrence and particulars of the circumstances and injury); treating physicians and care givers; and WCTL staff discussion with you the injured worker.

  9. Limiting Use, Disclosure and Retention
  10. We will use or disclose your personal and health information only for the purpose for which it was collected or otherwise if specifically authorized by you or as required or allowed by law. This may include any Workers Compensation Board internal review or appeals concerning any matter affecting disability entitlement or claims costs.

    WCTL retains personal and health information only as long as the information may be required for the purposes for which it was collected or as allowed by law. Secured storage facilities and practices will be used for appropriate archiving of paper and computer files.

    Paper files are kept for 6 months after the date in which all matters concerning the collection, use and disclosure of health and personal information are concluded. Access to computer files are restricted to the later of, five years from the date of accident or 2 years from when all matters concerning the health and personal information are concluded.

    We will not sell for any reason any personal or health information.

  11. Accuracy
  12. We will keep your Information accurate, complete and up-to-date for the period it is required by, conducting regular internal and supervisory reviews of all personal and health information that is required.

  13. Safeguard
  14. We will protect the security of the personal and health information with appropriate security safeguards including: secure storage; restricted access; password protection; transferring procedures; and sign off.

  15. Openness
  16. Our privacy policies are available to the public, any client, or any person identified by the personal and health information.

  17. Access
  18. Any individual may request access to their own personal and health information by submitting a written request to the WCTL Privacy Officer.

    We will forward the entire contents of all paper and computer files to our legal counsel for review and determination of what information can be legally disclosed to you. The legal counsel will contact you to confirm they have the information and will provide a cost estimate. The cost will not exceed $100.00 plus $.25 per page. All fees must be paid in advance of disclosure.

    Upon receipt of the access fee WCTL¹s legal counsel will provide the information within 21 days.

  19. Concerns, enquiries and requests
  20. You are entitled to question the Privacy Officer about our compliance with any of these principles. Any concerns, enquiries or requests relating to any privacy matter should be made in writing to the WCTL Privacy Officer.

Our Commitment to protecting your personal information.

Privacy - our commitment

Our commitment means we will protect your privacy and respect your right to have a say in how we collect, use and disclose your personal information. We have procedures in place which guide our employees in maintaining confidentiality. What has been our on-going business practice has now become our documented commitment to you.

In order to comply with privacy laws, Work Comp. Tech Ltd. (WCTL) has adopted principles for the protection of personal information, established related policies and procedures, and appointed a Privacy Officer. This document will give you a brief overview of our privacy commitments.

Personal Information

Why we need it

WCTL collects uses and discloses both personal and health information to help facilitate the recovery of injured workers - prompt safe recovery and rehabilitation of workers is our primary goal. By acting quickly and responsibly we minimize employer cost and maximize employee opportunity for full recovery.

How we collect information

We obtain this information directly from you, your employer and the Workers Compensation Board, as authorized by you and by law.

How information is disclosed or shared

Your personal and health information will only be used or disclosed for the purpose for which it was collected or as specifically authorized by you or as required or allowed by law. Typically, with consent, we will discuss the nature of the injury with treating physicians and care givers in order to facilitate your recovery. Information may also be disclosed or shared with:

  • Office staff whose duties normally include receipt of such information and who ensure that the proper parties receive this information;
  • Case management teams consisting of a case manager and nurse who use and disclose the information for the specified purposes;
  • Senior officers of WCTL who oversee all work related activities of their employees;
  • Consulting physicians who provide medical expertise to the case management team;
  • Legal counsel who provide legal advice and services to the case management team;
  • Workers Compensation Board as required;
  • Third party medical service providers as required;
  • Your employer, as designated to receive such information.

Opting Out

Any individual is entitled to withdraw their consent, at anytime, for the collection, use and disclosure of personal and health information by writing to WCTL¹s privacy officer. You will need to state your request and an effective date. Any withdrawal of consent is subject to legal and contractual or employment restrictions and considerations of your employer.

We will fully advise any dissatisfied person of their rights in the event WCTL is not able to fully satisfy their privacy related requests.
